Terms of Service
Cofoxi is operated by Akanksha, Germany ("Cofoxi," "we," "our"). Full legal-entity and postal details are in the Impressum.
These Terms are a contract between you and us. We tried to write them in plain language. If anything is unclear, email us at team@cofoxi.com and we'll explain — or fix the wording.
1. What Cofoxi does
Cofoxi is an ambient co-presence app for focused work. You join a small room with a handful of other people who are also focusing, and share audio and video for the duration of a timed session. Each room has a text chat. There are also solo quiet-focus features that don't involve other people.
2. Accepting these Terms
By creating a Cofoxi account or using Cofoxi, you accept these Terms and our Privacy Policy. We record the date and time you first accepted them when your account is created.
If you don't agree with any of these Terms, don't create an account. If you already have one and no longer agree, you can delete it any time from Profile → Delete account.
3. Who can use Cofoxi
- Minimum age: 13. You confirm that you are 13 or older.
- Accurate information. The name and email on your account should be your own. Impersonation isn't allowed.
- One person per account. Cofoxi accounts are personal. Please don't share your account with anyone else.
- Legal capacity. You must have the legal capacity to enter into this agreement in your country of residence.
4. Your account
- You can create an account with Sign in with Apple, Sign in with Google, or an email and password. We never see your Apple or Google password. If you sign up with an email and password, your password is handled securely by our authentication system and is never stored in a readable form.
- You're responsible for what happens through your account. Keep your device secure and sign out on shared devices.
- If you lose access to the account (device change, provider link broken), email us at team@cofoxi.com and we'll do what we can.
5. Acceptable use
Cofoxi is meant to feel like a quiet library — a shared room where everyone is present but no one is in each other's way. The rules that follow protect that feeling.
Do not:
- Harass, threaten, or intimidate anyone in a room, in chat, or through your check-in text or display name.
- Post hate speech or discriminatory content — anything targeting people for their race, ethnicity, religion, gender, sexuality, disability, or similar.
- Post nudity or sexual content in your video, audio, chat, check-in text, or profile.
- Spam or scam anyone — repeated unwanted messages, promotional posts, phishing, or fraudulent solicitations.
- Post other inappropriate content — including violent, graphic, or gratuitously disturbing material.
- Try to bypass safety tools. That includes evading our content filter with disguised words or numbers, using multiple accounts to avoid a ban, or trying to re-claim a free trial you've already used.
- Attack the service. No unauthorised access attempts, no automated scraping, no denial-of-service, no interference with other users' sessions.
- Break the law or use Cofoxi to help someone else do so.
These rules apply to everything you write, say, share, or broadcast inside Cofoxi — chat messages, camera and microphone streams, check-in text, display name, emoji, and any content you upload (including screenshots attached to reports).
The categories above align with the reasons you can select when you report someone: harassment, spam, inappropriate behavior, nudity or sexual content, and "something else."
6. Safety tools you can use
You have two independent tools inside every room:
- Report — report a specific chat message by long-pressing it and choosing a reason, or report a participant from their tile, where you can also attach a screenshot. Reports go to our moderation team.
- Hide — tap Hide on a participant's tile. Their camera, voice, and chat are muted for you only, in that session and every future session. Hides are private (no one else sees who you've hidden) and reversible from Profile → Hidden people. Hiding is one-directional: it removes their content from your view; it doesn't stop them from being in the room.
Filing a report and hiding someone are separate actions — you can do either, both, or neither. Neither notifies the other person.
7. Moderation and enforcement
We review reports within 24 hours of them being filed. Once a report is reviewed, depending on severity, we may:
- take no action,
- warn the reported user privately,
- remove specific content, or
- terminate the account by adding it to our access-revocation list. Once an account is on that list, the next sign-in fails and the person is signed out — they see a short message and cannot re-enter Cofoxi with that account.
Enforcement decisions are made by our team. We aim to be fair, and we prefer the lightest action that solves the problem — but repeat or serious violations, especially of §5, will lead to a termination.
We keep a minimal record of enforcement actions after account termination — this is described in the Privacy Policy §7 — so that banned accounts stay banned and so we can review our moderation history for consistency.
If you believe a moderation decision was wrong, email us at team@cofoxi.com with the details. We'll re-review.
8. Content you post
You own what you write. Your chat messages, check-in text, profile name and emoji, and any screenshots you attach to reports remain yours.
By posting content in Cofoxi you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content strictly for the purpose of running Cofoxi — showing your messages to other people in your room, showing your name and emoji on your tile, reviewing reports, and applying our moderation tools. We don't use your content for advertising, training AI models, or any purpose outside of running the service.
This licence lasts as long as the content exists in Cofoxi. It ends when the content is removed — except:
- content that has been snapshotted into a moderation record (see Privacy Policy §2 — Moderation reports) — that snapshot remains for our moderation history
- content that is part of an enforcement record after your account is terminated (Privacy Policy §7)
You are responsible for the content you post. Don't post anything you don't have the right to share.
9. Subscriptions
Cofoxi has a free tier and two paid tiers, currently:
- Premium — auto-renewing monthly
- Premium Plus — auto-renewing monthly
Prices, feature lists, and any free trial are shown on the paywall inside the app before you subscribe.
9.1 How billing works
- Payment is processed by Apple through your App Store account. Cofoxi never sees your credit-card details or Apple ID credentials.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Renewal charges hit the same payment method you originally used.
- Any current unused portion of a free trial period is forfeited when you purchase a subscription, per Apple's standard terms.
9.2 Cancelling and refunds
- Cancel any subscription from your iOS Settings → Apple ID → Subscriptions (or from the App Store app). Your paid features remain active until the end of the current billing period.
- Refunds are handled by Apple. If you believe you were wrongly charged, you can request a refund through Apple at https://reportaproblem.apple.com. We can't issue refunds directly through Cofoxi.
9.3 Statutory withdrawal and refund rights
Cofoxi subscription purchases are made through Apple's App Store, not directly with us. Any statutory withdrawal, cancellation, or refund rights you have for those purchases are exercised through Apple under Apple's Media Services Terms — in practice via Apple's refund process at https://reportaproblem.apple.com. Cofoxi neither processes payments nor issues refunds; cancellation as described in §9.2 prevents the next renewal but does not itself refund the current billing period.
9.4 If we change plan structure
If we change what a plan includes, change prices, or retire a plan, we'll notify you before the change takes effect — either through a notice in the app or by email to the address on your account. You can always cancel before the change lands if you don't agree with it.
10. Availability, updates, and changes
We try to keep Cofoxi running reliably, but we don't guarantee uptime. From time to time we may:
- update the app (new features, changes, bug fixes) — the App Store handles delivery
- pause or restrict features temporarily for maintenance or to respond to abuse
- change third-party providers listed in the Privacy Policy
We may add, change, or retire features. If a change is material to paid features, §9.4 applies.
11. Disclaimers
Cofoxi is provided "as is." We do our best, but:
- We don't guarantee your focus sessions will be uninterrupted or productive.
- We don't guarantee that anyone you meet in a room is who they say they are. Use the safety tools if someone makes you uncomfortable.
- We don't guarantee that reports are always acted on the way you'd hope. We commit to a 24-hour review (§7), not to a specific outcome.
- We don't guarantee that Cofoxi will remain compatible with every iOS version indefinitely.
To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Liability
Nothing in these Terms limits our liability for:
- death or personal injury caused by our negligence, or
- fraud or fraudulent misrepresentation,
- or any other liability that cannot be limited under applicable law (in particular under the German Produkthaftungsgesetz and mandatory consumer protection).
Subject to that:
- For consumer users, we are liable for damages caused by our intent or gross negligence, and for damages caused by simple negligence that arise from a breach of a material contractual obligation. In the latter case our liability is limited to damages that were typically foreseeable at the time the contract was concluded.
- For business users, we are liable only for intent and gross negligence, and our liability for simple negligence — including breach of material contractual obligations — is limited to damages that were typically foreseeable.
We aren't liable for consequences of user-generated content posted by other people. If someone in a room breaks these Terms, they — not Cofoxi — are responsible for the harm caused.
13. Termination
You can terminate at any time by deleting your account from Profile → Delete account. See Privacy Policy §7 for what is removed and what is retained.
We can terminate or suspend your access if you materially breach §5 (Acceptable use), attempt to bypass our safety tools, or use Cofoxi for illegal activity. For non-severe violations we usually warn first; for severe violations (e.g., threats, child safety issues) we terminate immediately.
Sections that by their nature should survive termination — §8's residual licence for retained moderation records, §11 (disclaimers), §12 (liability), §13 (this section), and §14 (governing law) — survive.
14. Governing law and courts
- These Terms are governed by the laws of the Federal Republic of Germany, excluding its rules on conflict of laws and the UN Convention on Contracts for the International Sale of Goods.
- If you are a consumer, this choice of law does not deprive you of any protection you have under mandatory consumer-protection law in your country of residence.
- For consumer disputes, the courts of your country of residence are competent to the extent required by mandatory law.
- For business disputes, the courts of the Federal Republic of Germany are competent.
We are not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
15. Changes to these Terms
We may update these Terms as Cofoxi evolves. The "Effective" date at the top always reflects the last substantive change. For material changes — for example, changes to the acceptable-use rules or to how subscriptions work — we take reasonable steps to inform you: a notice in the app, or an email to the address on your account where we have one. Material changes are notified before they take effect where required by law.
